1. Agreement to terms
These Terms & Conditions ("Terms") form a binding agreement between you (or the legal entity you represent, "Customer", "you") and Renterval LLC, a Delaware limited liability company operating as RentMy ("RentMy", "we", "us"). By creating an account, accessing rentmy.co, or using any RentMy product, you agree to these Terms, our Privacy Policy, and any policies referenced from them.
If you are entering into these Terms on behalf of a company, you represent that you have authority to bind that company. If you do not have that authority, do not create an account.
2. Definitions
- Service — the RentMy platform, websites, mobile apps, and APIs provided by RentMy.
- Customer Data — products, inventory, customer records, orders, waivers, signatures, and any other content you upload or generate through the Service.
- Renter — an end-customer who books or rents items through your RentMy-powered storefront.
- Documentation — RentMy's published help articles, API references, and product guides.
- Order Form — an online plan selection or signed enterprise agreement specifying your subscription tier and fees.
- Free Tier — the no-cost plan limited to five (5) processed orders.
3. Account & eligibility
You must be at least 18 years old and legally capable of entering into a contract to use RentMy. You must provide accurate, current information when creating an account and keep your credentials secure. You are responsible for all activity under your account, including activity by employees and team members you invite.
You may not create an account if you are subject to U.S. trade sanctions or located in a country embargoed by the U.S. government, or if you have previously been suspended from RentMy for a violation of these Terms.
4. Free tier & paid plans
RentMy offers a Free Tier that lets you explore the Service without charge. The Free Tier is limited to five (5) processed orders in total — not a time-based trial. Once you process your fifth order, you must select a paid plan to continue accepting new orders. Your data, configuration, and history are retained when you upgrade.
Paid plans are described on our pricing page and on any signed Order Form. Plan availability, feature gates, and usage limits are subject to the Order Form. If a Plan you select includes processor fees (e.g. the Nano per-order fee), those fees are charged in addition to your subscription.
5. Billing & payment
- Subscription term — month-to-month for self-serve plans; the term specified in the Order Form for Enterprise plans. Subscriptions auto-renew unless cancelled before the next billing cycle begins.
- Payment — fees are charged automatically to the payment method on file via Stripe. You must keep a valid payment method on file at all times.
- Setup fees — the one-time setup & training fee shown on the pricing page is non-refundable and is required to activate paid bookings on Nano and Growth plans.
- Taxes — fees are exclusive of taxes, levies, or duties imposed by taxing authorities. You are responsible for any such taxes other than RentMy's net income taxes.
- Late payments — overdue amounts may accrue interest at 1.5% per month or the maximum rate permitted by law, whichever is lower. RentMy may suspend the Service for non-payment after written notice.
- Refunds — except where required by law, all fees are non-refundable. We do not provide refunds or credits for partial months, downgrades, or unused features.
- Price changes — we may change subscription pricing at the next renewal with at least 30 days' notice. If you don't agree to a price change, you may cancel before the new rate takes effect.
6. License & restrictions
Subject to your compliance with these Terms and timely payment of fees, RentMy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal business purposes during the subscription term.
You will not, and will not permit any third party to:
- Reverse engineer, decompile, or disassemble the Service.
- Copy, modify, or create derivative works of the Service.
- Resell, sublicense, time-share, or use the Service to operate a service bureau on behalf of third parties not authorized in the Order Form.
- Bypass usage limits, rate limits, or technical protection measures.
- Use the Service to develop a competing product or to benchmark against a competing product without our written consent.
- Remove, alter, or obscure any proprietary notices on the Service.
7. Customer data & ownership
As between you and RentMy, you retain all right, title, and interest in your Customer Data. You grant RentMy a worldwide, non-exclusive license to host, copy, transmit, display, and process Customer Data solely as necessary to provide and improve the Service, including technical operations like backups and disaster recovery.
You are responsible for the accuracy, quality, and legality of Customer Data and for obtaining all consents and rights necessary for RentMy to process it. Where Customer Data includes personal data of Renters or others, you act as the data controller and RentMy acts as the data processor under our Data Processing Addendum.
RentMy will not use Customer Data to train machine-learning models, sell it to third parties, or use it for advertising. We may use anonymized, aggregated metrics for product improvement, security, and benchmarking.
8. Acceptable use
You will not use the Service to:
- Violate any law, regulation, or third-party right (including intellectual property and privacy rights).
- Send spam, phishing emails, or unsolicited bulk communications via RentMy's email or SMS features.
- Upload malware, viruses, or any content designed to harm or disrupt systems.
- Probe, scan, or test the vulnerability of the Service except under our coordinated disclosure program.
- Interfere with the proper operation of the Service or the experience of other customers.
- Use the Service to rent items that are illegal in the jurisdiction where the Renter is located.
- Engage in fraudulent transactions, money laundering, or sanctions evasion.

9. Third-party services & integrations
The Service integrates with third-party tools — including Stripe, Square, PayPal, Braintree, Google (Calendar, OAuth, Ads, Analytics), Shopify, WooCommerce, WordPress, Squarespace, QuickBooks, Zapier, and others. Your use of those tools is governed by their own terms and privacy policies. RentMy is not responsible for third-party services and their availability, accuracy, or behavior.
If you connect a payment processor, your relationship with that processor (e.g. Stripe Services Agreement) is between you and the processor. RentMy does not hold funds or act as a financial institution.
10. Intellectual property
RentMy and its licensors retain all right, title, and interest in the Service, including all software, design, content, trademarks, and Documentation. Nothing in these Terms transfers any RentMy intellectual property to you. Your only rights in the Service are those expressly granted in §6.
If you submit feedback, suggestions, or feature requests, you grant RentMy a perpetual, irrevocable, royalty-free license to use that feedback in any way without obligation to you.
11. Confidentiality
"Confidential Information" means any non-public information disclosed by one party to the other that is identified as confidential or that should reasonably be understood to be confidential. Each party will protect the other's Confidential Information with the same care it uses for its own (and at minimum reasonable care), and will not disclose it to third parties or use it for any purpose other than performing under these Terms.
Confidential Information does not include information that is publicly known, was already in the recipient's possession without obligation of confidentiality, was independently developed without use of the disclosing party's information, or is rightfully received from a third party without restriction.
12. Term & termination
These Terms remain in effect while you have an active account. Either party may terminate for material breach if the other party fails to cure the breach within 30 days of written notice. RentMy may suspend or terminate immediately for: non-payment after notice, suspected fraud or abuse, security threats to the Service, or compliance with legal process.
You may cancel your subscription at any time from your account settings. Upon termination:
- Your access to the Service ends.
- You may export Customer Data for up to 30 days following termination using the in-app export tool.
- RentMy will delete or anonymize Customer Data per the retention schedule in our Privacy Policy.
- Sections that by their nature should survive termination (IP, confidentiality, liability, disputes) will survive.
13. Disclaimers & warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTMY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE COMPLETELY SECURE OR NOT LOST OR ALTERED.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. RENTMY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO RENTMY IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
The limitations in this section do not apply to (i) breaches of confidentiality, (ii) indemnification obligations, (iii) infringement of intellectual property rights, or (iv) liability that cannot be limited under applicable law.
15. Indemnification
You will defend, indemnify, and hold harmless RentMy, its affiliates, and their officers, employees, and agents from any third-party claim, demand, or proceeding arising out of (i) your use of the Service in violation of these Terms or applicable law, (ii) your Customer Data, (iii) your business activity (including disputes with Renters), or (iv) your violation of any third-party right.
RentMy will defend you against any third-party claim that the Service, when used as authorized, infringes a U.S. intellectual property right, and will pay damages finally awarded by a court or agreed in settlement. Our indemnity does not apply to claims arising from your unauthorized modifications, combinations with non-RentMy products, or use after we notify you to discontinue.
16. Dispute resolution & governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution. Before filing a claim, the parties will attempt to resolve any dispute by sending written notice to [email protected] and conferring in good faith for at least 30 days.
Binding arbitration. Any dispute that cannot be resolved informally will be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will take place in San Jose, California, and judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. Disputes will be brought in your or RentMy's individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Equitable relief. Either party may seek injunctive or other equitable relief in court for misuse of intellectual property, confidentiality breaches, or violations of §6 or §8.
17. General provisions
- Entire agreement. These Terms (together with any Order Form, the Privacy Policy, the DPA, and the policies linked from them) are the entire agreement between you and RentMy and supersede prior agreements.
- Order of precedence. If there's a conflict, an executed Enterprise Order Form takes precedence over these Terms, which take precedence over linked policies.
- Modifications. We may update these Terms from time to time. Material changes will be announced by email or in-product notice with at least 30 days' notice. Continued use after the effective date is acceptance.
- Assignment. You may not assign these Terms without our prior written consent. RentMy may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failures caused by events beyond its reasonable control (acts of God, war, government action, internet outages, etc.).
- No waiver. Failure to enforce a provision is not a waiver of the right to enforce it later.
- Severability. If a provision is found unenforceable, the remainder of these Terms remains in effect.
- Notices. Notices to RentMy must be sent to [email protected]. Notices to you may be sent by email to the address on your account or by in-product notification.
- Independent contractors. The parties are independent contractors. Nothing creates a partnership, joint venture, or employment relationship.
